Terms of Service

These Terms of Service (the “Terms”) set out the conditions for using Prefix Phone (the “Service”) provided by Beruk (the “Operator”). By using the Service, you agree to these Terms.

1. Overview of the Service

• The Service is a phone app used as the default phone app on Android
• When you place a call, it automatically adds the number of the discount calling service you have set up (the “prefix number”). You can choose whether to add it, and which number to use, per SIM and per contact
• Other features include call history, contacts, a keypad, call blocking, shop names for incoming calls, rating numbers after calls, and bookmarks
• The Service is free to use. Call charges are paid to the phone carrier and discount calling service you have contracted with

2. Relationship with discount calling services

• The Operator is not affiliated with any discount calling service or phone carrier. The Service is not an official app of any of them
• To use a discount calling service, you must apply for and contract with that service yourself. Its terms, prices and the types of numbers it supports are determined by each service
• Whether the Service adds a prefix number depends on rules set by the Service according to the type of number (mobile, landline, toll-free, emergency, etc.). We do not guarantee that these rules match the conditions of the service you have contracted with
• Information about discount calling services shown in the Service (numbers, prices, etc.) is as of when the Operator checked it. Please check each service’s official website for the latest information
• Some introductions of discount calling services may earn the Operator a referral fee. These are labeled “PR”

3. Notes on call charges and call results

• Call charges are borne by you according to the rates of your phone carrier and discount calling service. We do not guarantee that using the Service will lower your call charges
• In cases such as the following, the prefix number may not be added, the discount may not apply even if it is added, or the call may not connect:
  • You have not contracted with a discount calling service, or you called a number not covered by your contract
  • The prefix number you set is incorrect
  • The discount calling service has changed or ended
  • Due to the specifications of your device, OS or carrier, or network conditions
• You can check the number that will actually be dialed on the keypad before calling. If you are concerned about charges, please check before calling
• Prefix numbers are not added to emergency calls (110, 118, 119). However, depending on your device, OS or network conditions, you may not be able to make emergency calls from the Service

4. Shop names and search during incoming calls

• Shop names shown for incoming calls and in history are based on publicly available shop information (Overture Maps Foundation data). We do not guarantee that shop names are accurate or up to date. A shop name being shown does not mean the call is from that shop
• While a call from a number not in your contacts is ringing, Google search results for that number are shown. Search results are provided by Google, and the Operator is not responsible for their content

5. Number ratings

• After a call, you can send a rating of the other party’s number (“glad I answered” or “unwanted”) and optional text
• You grant the Operator a free license to use the ratings and text you send (“Ratings”) for the following purposes, including copying, editing, translating and publishing them. This license continues until you ask us to delete the Ratings and is valid in Japan and abroad:
  • Detecting unwanted calls in the Service and letting users know
  • Publishing web pages that combine information and ratings for the phone numbers of shops and businesses
• When publishing Ratings, the Operator does not show user IDs and removes information that could identify a person, such as personal names, from the text. The Operator does not rewrite Ratings in a way that changes their meaning
• You must base Ratings on calls you actually received or made and what was actually said, and you represent that you have the right to send them. You agree not to exercise moral rights against the Operator with respect to Ratings
• The Operator may decide whether and which Ratings to publish. Ratings that may violate laws or these Terms may not be published or may be deleted
• You can request deletion of Ratings through the inquiry screen in the app. The Operator may also, at its discretion, delete published Ratings at the request of the owner of the number or others

6. Prohibited conduct

When using the Service, you must not:

• Send false ratings or ratings about calls you did not actually receive or make
• Include information that could identify a person, such as names, addresses or phone numbers, in rating text
• Send ratings that defame others or damage their reputation or credit
• Send ratings for the purpose of unfairly manipulating the rating of a particular number, such as disparaging a competing shop or business (including stacking ratings on the same number using multiple devices or IDs)
• Use the Service for prank calls, nuisance calls, fraud or other calls that cause trouble or harm to others
• Place excessive load on the Service’s servers, or send ratings or inquiries by automated means
• Reverse engineer the Service, exploit vulnerabilities or circumvent authentication
• Engage in any other conduct that violates laws or public order and morals

7. Measures for violations

If the Operator determines that you have violated these Terms, it may, without prior notice, delete Ratings you have sent or stop accepting further Ratings from you. Where necessary, the Operator will report to law enforcement or other authorities.

8. Disclaimer

• The Service is provided as is. The Operator does not guarantee that the Service will operate without interruption or errors, that it is fit for a particular purpose, or that you will achieve the savings on call charges you expect
• Except in cases of willful misconduct or gross negligence by the Operator, the Operator is not liable for:
  • Increased call charges resulting from a prefix number not being added or an unintended number being added
  • Calls not connecting, failing to receive incoming calls, or being unable to receive calls due to call blocking
  • The content of shop names, ratings or search results
  • Problems caused by discount calling services, carriers, devices, the OS or other third parties
  • Disputes between users, or between users and third parties
• If you suffer damage due to the Operator’s negligence (excluding gross negligence), the Operator is liable only for direct and ordinary damage actually incurred by you

9. Changes to or termination of the Service

• The Operator may change the content of the Service without prior notice
• The Operator may end the Service. In that case, it will give notice in the app or elsewhere a reasonable period in advance

10. Fees

• The Service is provided free of charge
• If paid features are offered in the future, their content and prices will be announced in advance, and fees will be charged only if you sign up for them

11. Changes to these Terms

• The Operator may change these Terms as necessary. When doing so, it will announce the changed content and the date it takes effect in the app or on this page before it takes effect
• If you use the Service on or after the date the changes take effect, you are deemed to have agreed to the changed Terms

12. Governing law and jurisdiction

• These Terms are governed by and construed in accordance with the laws of Japan
• The Tokyo District Court has exclusive jurisdiction as the court of first instance for disputes relating to the Service
